Access and exclusions

Available in the recorded evidence · evidence dated .

Excluded US states: NY, ME.

Kraken has run since 2011, which puts it among the older large crypto exchanges still serving US customers 1. This review works only from a dated evidence evidence record: what the documentation shows about access, costs, custody and past regulatory trouble, and what it leaves open. No account was opened and no trade was placed for it.

Who this exchange suits

Kraken fits a US resident who trades on the advanced Kraken Pro interface, values a long public reserve-reporting history, and lives outside the two states where it does not operate. It fits less well if you expect the simple one-tap buy screen to be the cheap route, or if you want a promise that your balance is insured.

The operating entity for US customers is Payward Interactive, Inc., and Kraken's own licensing page describes its US registrations as a money transmitter 10. Registration is a compliance status, not a government endorsement of the platform and not a guarantee your funds are protected.

Read the rest of this page as a conditional call. The value on Pro is solid for an eligible resident, weaker on the retail screen, and set against a documented enforcement and breach record you should weigh before you fund an account.

US access and New York restrictions

Kraken serves residents across most of the United States, but its support documentation lists two states where you cannot register: New York and Maine 310. That exclusion attaches to the platform itself, so a New York resident is not eligible regardless of which product they want.

New York sits in its own scope. Kraken does not hold the New York approvals that would open a residency path, and nothing in the supplied record creates one for New Yorkers 10. Do not read general US availability as covering the state - US-NY is a separate case, and the platform's national footprint says nothing about it.

One more distinction matters here. Kraken's payments app, Krak, carries its own set of state limits that differ from the main exchange, which is exactly why platform access and individual-product eligibility are not the same question 10. The US operator is Payward Interactive, Inc.; the Delaware parent, Payward, Inc., is the name attached to the older OFAC settlement covered further down 2. When you check your own eligibility, keep the operator, the product and the state scope apart.

Trading fees and withdrawal costs

Kraken runs two pricing worlds, and conflating them is the common mistake. On Kraken Pro, the base Tier 1 rate is 0.40% for makers and 0.80% for takers, measured on low 30-day volume, and the rate steps down across higher tiers as volume grows 131434. A maker order adds liquidity to the book; a taker order removes it, which is why the taker side costs more.

The simple buy screen on Kraken.com is a different route. Independent review of it puts the cost near 1% plus a spread folded into the quoted price, which is why the documented field for no hidden fees reads no 15. Put plainly, the retail screen is not a no-spread product the way Pro pricing is, so the headline 0.40% is not a universal all-in price for every way you buy.

Network withdrawal costs sit partly outside this evidence record. The supplied material carries fiat examples, such as a SEPA euro withdrawal around 1 euro, but no Bitcoin withdrawal fee, so treat on-chain costs as something to check on Kraken's own schedule before you move coins 15.

Documented item Dated value / scope Practical implication
Maker fee, Kraken Pro Tier 1 0.40%, base tier (2026-09-26) Lowest published entry rate; applies on Pro and falls with volume 131434
Taker fee, Kraken Pro Tier 1 0.80%, base tier (2026-09-26) Costs more than maker; often the rate you actually pay 131434
Simple buy screen ~1% plus built-in spread; no-hidden-fees field reads no (2026-09-26) Retail route is pricier than Pro, not a no-spread product 15
US state exclusions New York and Maine excluded (2026-09-25) No registration path if you reside there 310
OFAC settlement $362,158.70, resolved (2022-11-28) Dated, closed matter, not an active case 2
Proof of Reserves snapshot As of 2025-09-30, includes liabilities (2026-09-25) Shows reserves against liabilities; not deposit insurance 5

Security, reserves and incident history

Two security controls are documented in the supplied material: funds held in cold storage and account protection through passkeys and two-factor authentication 1. Both are standard protections, and neither removes the risk of loss. A documented control is a control, not a guarantee.

Kraken has published Proof of Reserves since its early years, and the latest snapshot in the evidence record is dated 30 September 2025 5. It uses a Merkle-tree method that includes customer liabilities, so a client can check that their own balance is part of the attested total, with an independent firm confirming on-chain assets exceed what the exchange owes customers 5. What this does not do is insure your deposit or replace funds if something goes wrong. It is a transparency measure, not FDIC-style protection.

The record carries real incidents. On 13 April 2025 Kraken disclosed two related breaches in which compromised or bribed support-team staff reached customer-support data for about 2,000 accounts, roughly 0.02% of its user base, followed by an extortion attempt; the company states customer funds were not affected 678. That is a dated, disclosed event, not evidence of an ongoing problem.

Earlier, in a settlement dated 28 November 2022, Kraken paid OFAC $362,158.70 over 826 transactions tied to users in Iran, where geo-screening had been applied only at onboarding rather than across an account's life 2. The matter is resolved, and the figure reflects a past enforcement action, not a current penalty.

Products, support and evidence limits

Spot trading, margin, crypto perpetuals, staking and recurring buys are all documented as part of the lineup 1. The Kraken Card is one to watch for scope: it is documented for verified customers in the UK and EEA and is not available in the US 1, another case where a global feature does not establish US access. Support runs through 24/7 live chat and email, with no direct phone line, though the app offers a call-back feature 1.

Some things the evidence record does not settle. Published asset counts differ widely across reviews, from a few hundred to over 600, with no US-specific breakdown, so treat any single asset-count number as approximate 1. There is also no Bitcoin withdrawal fee and no SOC 2 or bug-bounty detail in this dataset. Absence here means the evidence record does not record it, not that the feature is missing.

How to decide whether it fits

Work through these before you commit:

  • Geography and identity: confirm you do not reside in New York or Maine, where registration is closed 310.
  • Intended operation: decide whether you will trade on Kraken Pro or use the simple buy screen, because the cost gap between them is wide 1315.
  • Cost or status limit: for on-chain moves, check Bitcoin withdrawal fees on Kraken's own schedule, since this evidence record does not carry them 15.
  • Custody and provider boundary: treat Proof of Reserves as a transparency snapshot, not deposit protection, and keep large long-term holdings in your own wallet 5.
  • Next step: if you are eligible and plan to trade on Pro, the documented pricing is competitive; if you only want one-tap buys, compare the spread first.

The short version: a conditional fit for eligible Pro traders, a weaker fit for New Yorkers and for casual retail buyers.

Quick questions

Is Kraken available in New York? No. Kraken's documentation lists New York among the states where you cannot register, and the supplied record shows no residency path for the state 310. A New York resident is not eligible regardless of product.

Do the stated charges cover every transaction? No single all-in total applies. The 0.40% maker and 0.80% taker rates are Kraken Pro figures, while the simple buy screen runs near 1% plus spread, and some withdrawal costs are not in this evidence record 1315.

Was a trade or withdrawal tested for this review? No. This is an editorial review of supplied documentation, with no account opened and no transaction placed.
